FPS Website Terms of Use and Privacy Policy

  1. PLEASE READ THESE TERMS AND CONDITIONS PRIOR TO USING THIS WEBSITE AS THEY CONTAIN INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS WHEN USING www.frenchpropertyshop.com; and linked "other language" websites such as www.propertyjunction.com ; www.fps-immo.be; www.fps-immo.fr; www.fps-vastgoed.nl; www.fps-immo.de; www.fps-inmo.es; www.fps-nedvizimost.ru; www.fps-hus.se; www.fps-agenziaimmobiliare.it; www.fpsimmo-propertyjunction.com ('the Websites') whether as a member of the general public, a private advertiser, developer, an estate agent or other commercial entity so that when you use these sites you agree to the following Terms and Conditions. If you do not agree to be bound by these Terms, you may not use these sites.
  1. FPS and Property Junction are the trading names of The French Property Shop Limited of Highwood, Brightling, East Sussex TN32 5HP.
  2. The Advertiser (whether a private advertiser, developer, an estate agent or other commercial entity) is the party who agrees to buy and/or place the property advertising services offered by FPS on the Websites ('the Services')
  3. The User is the party who browses the Websites for property offered by Advertisers.
  4. The Advertiser and not FPS is entirely responsible for the accuracy and truthfulness of the property particulars and photos ('the Content') submitted by the Advertiser who must ensure that the Content is faithful and accurate and complies with all applicable legislation, regulations, codes and guidelines under English, French and European law.
  5. The Advertiser confirms that the Content has been prepared solely by the Advertiser and, in the event of any claim by any third party, agrees to indemnify FPS against any losses, costs and expenses of whatever nature arising from any misdescription of the property or any other cause of action arising on the sale of the property.
  6. The Advertiser grants FPS the right in its absolute discretion, and without need for notice or explanation, to edit, modify or decline to display any part of the Advertiser's Content.
  7. For the agreed fee, payable by the means described on the Websites, Private Advertisers (those not in full or part time business as estate agents, property developers, notaires, solicitors, mortgage brokers, insurance brokers and so forth) may advertise a single property for a period of up to twelve months. The advertising service offered by FPS determines immediately and is not subject to any pro rata apportionment following any decision by the Advertiser to sell or withdraw the property. The twelve month period is not transferable to any additional property which would require a new advertisement and a further fee. Advertisers must advise FPS immediately of any agreement to sell or any decision to withdraw their property from the Websites.
  8. Private Advertisers accept that it is their responsibility to deal with any Users who show interest in their property. FPS has no role in this respect and will not deal with any issues of whatever nature arising between Advertisers and Users. FPS shall not be liable for any claims, expenses, losses or damages arising following dealings with Users who have made contact with the Advertiser via the Websites.
  9. Adverts shall be advertised on the Websites from the date of cleared payment of the advertising fee and can be withdrawn from the Websites at anytime by the Advertiser and republished during the same 12 month period.
  10. Trade Advertisers (those in full or part time business as estate agents, property developers, notaires, solicitors, mortgage brokers, insurance brokers and so forth) may advertise multiple properties or services for the price, fees, subscription or commission as described in the relevant sections of the Websites or by individual agreements between them and FPS. The advertising service offered by FPS determines immediately and is not subject to any pro rata apportionment following any decision by the Trade Advertiser to withdraw their advertising.
  11. FPS makes no representation or warranty that all or part of the Websites will be accessible at all times for technical or any other reason and the Advertiser agrees to waive any right to compensation or expenses or losses arising from any inability to access the Websites during the twelve month period.
  12. The price of the Services shall be stipulated on the Websites. FPS does not charge Private Advertisers commission on properties sold via the Websites.
  13. Payment of Advertising charges are to be paid in advance. Other payments are due within 30 days of the invoice date. Payments must be made without deduction or set-off. In the event that payment is not received, FPS may cease or suspend any part of the Services until payment has been received and the Advertiser agrees to pay a reasonable administration charge for dealing with any late payment problems.
  14. All orders for Services shall be deemed to be an offer by the Advertiser to purchase Services under these Terms and Conditions and are subject to acceptance by FPS which may choose not to accept an order for any reason.
  15. FPS reserves the right to revise prices on the Websites.
  16. FPS shall perform the Services with reasonable skill and care however FPS does not guarantee that the Advertiser will find a buyer on the Websites nor that Services will be faultless or that any data generated in connection with the Services will be complete or up to date.
  17. The Advertiser will act entirely in good faith and not use the Websites for any fraudulent or illegal purposes.
  18. Subject to any fraudulent statements or misrepresentation, this agreement is the entire agreement between FPS and the Advertiser and it will supersede any other oral or written agreement. No amendment to this agreement will be valid unless it is agreed in writing.
  19. This agreement is not intended to affect the Advertiser's legal and consumer rights.
  20. These Terms and Conditions shall be governed by and construed in accordance with the law of England and FPS and the Advertiser submit to the exclusive jurisdiction of the English courts.
  21. The copyright and all other intellectual property rights in this Site (including all database rights, trade marks, service marks, trading names, text, graphics, code, files and links) belong to us. Subject to clause A, you may download material from this Site for the sole purpose of using this Site. However, you must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Site without our prior written consent.
  22. This Site contains links to websites operated by third parties. We have no control over their individual content. We therefore make no warranties or representations as to the accuracy or completeness of any of the information appearing in relation to any linked websites. The links are for your convenience only. We do not recommend any products or services advertised on those websites. If you decide to access any third party website linked from this Site, you do so at your own risk.
  23. We reserve the right to withdraw or amend the services we provide on this Site without notice. We will not be liable if for any reason this Site is unavailable at any time or for any period.
  24. From time to time, we may restrict access to some parts of this Site, or this entire Site, to users who have registered with us.
  25. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.
  26. We collect personal information from you (such as name, address, telephone number and email address) when you complete registration or enquiry forms or send emails to us. Please do not submit your personal information to us if you do not wish us to collect it.
  27. In addition to personal information, we may collect information about you automatically when you visit the Site. The collection of information may involve the use of cookies and web beacons. A web beacon is a small graphic image placed on a web page that is designed to allow us to monitor traffic on the Site. A cookie is a small text file that is placed on your computer's hard drive by your web browser when you first visit the Site. The cookie allows us to identify your computer and find out details about your last visit. Most internet browsers accept cookies automatically, but usually you can alter the settings of your browser to erase cookies or prevent automatic acceptance if you prefer. If you choose not to receive our cookies, we cannot guarantee that your experience with the Site will be as quick or responsive as if you do receive cookies.
  28. Subject to obtaining your consent, we may also supply personal information about you to third parties. We reserve the right to disclose your personal information to comply with applicable laws and government or regulatory bodies' lawful requests for information. We may transfer, sell or assign any of the information described in this policy to third parties as a result of a sale, merger, consolidation, change of control, transfer of assets or reorganization of our business.
  29. The French Property Shop is a UK registered company, VAT number 683206828. If you are a UK registered business or resident, then VAT will be applied at the prevailing rate. If you are a non-UK EU business, then this is a reverse charge supply and is outside the scope of UK VAT. If you are a Private French resident customer then our charge includes the standard rate of UK VAT.

Refund/cancellation policy

If, as either a Trade or Private Advertiser, you are unhappy with our service we undertake to listen to your concerns and act to remedy these concerns. Entirely at our discretion, such remedy may include a partial or full refund.
