- If the tree is supposed to grow higher than 2 metres, a minimum distance of 2 metres from the neighbouring wall (boundary) must be allowed.
- If a branch goes into a neighbouring property the occupier does not have a right to prune it without consent. However the neighbour can cut the roots of the trees if they like.
- If leaves from a neighbour block your gutter the courts can take no action unless there is proof the neighbour hasn't tried to stop it at all after being told about it or the tree was planted too close in the first place, obstructing boundaries.
- House insurance covers fallen trees.
- If your sunlight is blocked by a neighbouring tree then you cant do anything unless its proved that they are doing it intentionally.
- You have no legal right to tend to your garden as long as it does not cause a health risk or go into the neighbouring garden or property.
