WATER RIGHTS for PROPERTY and PROPERTIES FOR SALE in FRANCE


•    All owners accept receipt of free flowing water onto their property, no matter where its from and must not try and divert the flow of the water to another property. If so you risk facing legal action.

•    The owners of a house with a spring in it, a source of water, can use that water for whatever purposes they want. Even sell it, or if you want get rid of it. Unless it sources from a river.

•    Farmers can, if they want, have property owners grant them permission to install a drain on their property. As long as it doesn't pass through the garden.

•    If you are lucky enough to be the owner of a private stretch of river or stream then it is important to remember that it is ownership of the bed only and not the water itself. If you don't know whether its private or not contact the local authorities. Don't mess with private waters.

•    In the case of public waterways, there are rights of way that govern the use of the towpath for public use.

•    If you own a shoreline or beachside property then there are rights of way over the property that may be granted to members of the public.
